Kingsley Advisory Group — Diagnostic

1. About these terms
These Terms of Use govern your access to and use of the Kingsley Advisory Group ("KAG") Diagnostic tool and the written analysis it produces. By submitting an intake or otherwise using the Diagnostic, you agree to these Terms.
These Terms apply only to the free Diagnostic offered through diagnostic.kingsleyadvisorygroup.com and related domains. Any paid engagement, consultation, retainer, or scope of advisory work that may follow from the Diagnostic is governed by a separate written engagement letter between you and KAG; these Terms do not apply to that work.
If you do not agree to these Terms, do not submit an intake.
2. What the Diagnostic is
The KAG Diagnostic is a desk-based written analysis prepared from information you supply at intake. It is structured to give you a senior-operator read on your project: where it sits today, the risks worth taking seriously, and what to do next. Each Diagnostic is reviewed by KAG's Principal before release.
The Diagnostic is not:
- Licensed engineering, architectural, or building-code advice
- A construction estimate, quantity survey, or formal cost plan
- Legal advice, accounting advice, or financial advice
- A substitute for site investigation, structural assessment, or any other licensed professional opinion
- A representation that the project as described is feasible, code-compliant, financeable, or buildable at the budget or on the timeline you supplied
The Diagnostic is provided to assist you in framing decisions about your project. It is not a substitute for the licensed professional advice required to validate those decisions before you act on them.
3. Your information
Information you provide at intake is governed by the Privacy Policy. By submitting an intake you confirm that:
- The information you provide is accurate to the best of your knowledge
- You are entitled to provide that information (for example, you are not submitting another party's project details without authorization)
- You understand the information will be used to prepare your Diagnostic and may be retained in accordance with the Privacy Policy
We rely on the information you provide. We do not independently verify project addresses, ownership, budget figures, scope descriptions, or any other input. The Diagnostic is only as accurate as the information it is built on.
4. Third-party information referenced
The Diagnostic may reference third-party information including, without limitation: regional cost benchmarks, building-code references, market conditions, tariff or trade-policy commentary, permitting timelines, financing conditions, and labour-market conditions.
These references are drawn from sources KAG considers reasonable at the time of writing. They are subject to change without notice, and KAG does not warrant their completeness or accuracy. You must verify any third-party reference with the appropriate licensed professional or current published source before relying on it for a decision.
5. No professional relationship from the Diagnostic alone
Receipt of a Diagnostic does not create:
- A retainer between you and KAG
- An ongoing advisory or professional relationship
- A duty of care that extends beyond the four corners of the Diagnostic as delivered
- An obligation to update, correct, or supplement the Diagnostic after delivery
A professional relationship is established only if and when you and KAG sign a separate written engagement letter for scoped work.
6. Limitation of liability
To the maximum extent permitted by law, KAG's total aggregate liability to you arising out of or relating to the Diagnostic — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — is limited to the greater of:
- (a) the fees you paid to KAG for the Diagnostic, or
- (b) one hundred Canadian dollars (CAD $100).
The Diagnostic is currently provided at no cost. The CAD $100 floor in (b) is the operative cap for any Diagnostic delivered without a fee.
To the maximum extent permitted by law, KAG is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profit, revenue, business opportunity, goodwill, data, or anticipated savings, arising out of or relating to the Diagnostic, whether or not KAG was advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
7. Your responsibility
You remain responsible for:
- Validating any recommendation in the Diagnostic with the appropriate licensed professional (structural engineer, architect, building-code consultant, lawyer, accountant) before acting on it
- All decisions you make regarding your project
- All contracts you enter into with contractors, designers, consultants, or other parties
- The accuracy of the information you provide at intake
- Compliance with all laws, codes, permits, and regulatory requirements applicable to your project
The Diagnostic is a tool for thinking. The decisions remain yours.
8. Intellectual property
The Diagnostic — including the analysis, structure, format, methodology, benchmarks, and written commentary — is the intellectual property of Kingsley Advisory Group. You may use the Diagnostic for the purpose of evaluating and advancing the specific project for which it was prepared, including sharing it with your design team, contractor, lender, or other professional advisors involved in that project.
You may not:
- Republish, resell, or distribute the Diagnostic publicly
- Use the Diagnostic, its methodology, or its language for the purpose of building a competing advisory product
- Remove or alter any KAG branding, attribution, or notices on the Diagnostic
9. No referral or fiduciary relationship
The Diagnostic may name service categories (for example, structural engineer, energy advisor, designer) or reference cost benchmarks tied to particular regions or trades. These references are illustrative. KAG does not receive referral fees, commissions, or any other compensation from any third party named or referenced in the Diagnostic. KAG is independent advisory.
Receipt of a Diagnostic does not place KAG in a fiduciary, agency, or representative relationship with you.
10. Changes to the Diagnostic or to these Terms
KAG may change the Diagnostic, the intake, the methodology, or these Terms at any time. The version of the Terms in force at the time of your intake submission is the version that governs that submission. The current version is the one published at kingsleyadvisorygroup.com/terms.
11. Governing law and forum
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Diagnostic or these Terms is subject to the exclusive jurisdiction of the courts of British Columbia, and you and KAG submit to that jurisdiction.
12. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and KAG with respect to the Diagnostic, and supersede any prior understanding on the same subject matter.
